Since state law only allows the Insurance Commissioner to establish non-binding arbitration, it seems to me the Scruggs’ adversion to Commissioner Dale’s settlement has nothing to do with the actual settlement but more to do with politics.
Scruggs hates Dale because he pushed for arbitration and he has State Farm looking at the slab cases-and settlements are happening. 5th settlement just hit. And that’s taking money away from scruggs’ MILLION dollar fees and his publicity. Scruggs is now being sued by other attorneys over fees. Good grief! Worst thing that could happen would be a scruggs-puppet getting into insurance comm position.
