Governor Barbour has been quoted as saying he does not need legislative approval to implement his latest plan to tax Mississippi’s hospitals to pay for the alleged Medicaid
deficit. He is also quoted as saying his new plan is a “fair, permanent, sustainable solution” to the alleged budget shortfall.
The Mississippi Hospital Association strongly disagrees with both of these assertions. Both state statute and Hinds County Chancery Judge William Singletary are crystal clear in
their instructions that only the Legislature has the authority to tax hospitals. Both state statute
and Judge Singletary’s ruling are crystal clear that the Governor cannot increase the UPL assessment on hospitals in order to cover a budgetary shortfall.
