Zach Scruggs has replied to the Government on his motion to disqualify

One constant theme in Zach Scruggs’s reply to the Government response on his disqualification motion is this: Well, if the Government isn’t going to call Bob Norman as a witness to explain his statement about Langston’s testimony, we won’t either. So that part of the motion to disqualify is moot.

That part of the motion to disqualify is what Judge Biggers has set for a hearing next Monday; I would take his setting of that for hearing as implying he takes that issue most seriously of all the issues in the motion to disqualify, and so am slightly surprised that Zach Scruggs has dropped that issue now. It’s one of several aspects of this reply that puzzle me.
