Scruggs hearing: Hearing closes without expert witness

Action resumes in Zach Scruggs’ hearing seeking to throw out his 2008 conviction and sentence for a guilty plea to knowing about but not reporting a colleague’s illegal conversation with Judge Henry Lackey.

Senior Judge Neal Biggers is expected to consider whether to allow Dr. Robert Leonard to testify as an expert in linguistics. The government has objected to his being allowed to testify.

At issue is whether 37-year-old Scruggs can prove he is innocent of what’s left of a six-count indictment against him in a conspiracy to bribe Lackey in 2007. Last week, Biggers threw out 3 1/2 of the counts, saying federal bribery charges did not apply in this case.
